GENERAL TERMS AND CONDITIONS as of 11 April 2013
When a person on behalf of a travel agency, tour operator or other travel organisation (hereinafter referred to as ‘Client’) or an individual customer ('Customer') that is registered with World Train Travel (hereinafter referred to as ‘WTT’) pays WTT a deposit or full- or part-payment for the cost of travel on a journey on a train or on a tour or for another service, operated by a train company, tour operator or service provider (hereinafter referred to as ‘Provider’), as presented by WTT, the Client / Customer enters into an agreement with the Provider for all matters relating to the journey or service connected to the booking, and full acceptance of these Terms and Conditions, and those of the Provider by the Client / Customer is assumed.
WTT is an agent; the contract is between the Client or Customer and the Provider.

RAILWAY OPERATORS’ AND OTHER CARRIERS’ CONDITIONS
The relevant conditions of carriage and byelaws of the railway operators over whose lines The Client’s customers travels are incorporated into the contract together with those of any other carrier.
The contract also includes, where applicable, the Uniform Rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) which are applicable to the Berne Convention concerning international carriage by rail.
VARIATIONS OF THESE TERMS AND CONDITIONS
These conditions are subject to variation at any time.
Any variation will be displayed here and you will be deemed to have accepted a variation if you have made a booking after it has been displayed.
These Conditions and any appendices shall take effect on the date displayed above until further notice, or as superseded by later versions.
The Client is hereby notified that it must ensure the Client's customers have adequate insurance cover for the travel, tour or service booked by the Client with WTT. Similarly the Customer must have adequate insurance cover for the travel, tour or service booked by the Customer with WTT. Cover must include refunds, cancellations and travel plan alterations, howsoever caused. WTT accepts such a booking on the strict understanding that this insurance cover is in place.
PASSPORTS & VISAS
The Client / Customer is responsible in ensuring passports and visas, as may be required, are valid prior to departure, and for the entire duration of the journey.
BOOKINGS AND RESERVATIONS
When a ticket, tour or other service (hereinafter referred to as ‘ticket’) is reserved, WTT sends an email confirming the booking, with a booking reference number.
A booking fee may be charged.
Examine tickets carefully upon receipt. Both the Provider and WTT accept no liability for ticket errors resulting from incorrect information provided by you.
If there is any inaccuracy, the Provider must be notified within 24 hours of receipt of your tickets.
The Provider aims to ensure that all tickets booked through WTT are issued correctly and efficiently but in the event of any error or delay occurring in connection with the booking or the issue of tickets, the maximum liability to the Client or Customer will be to refund the price of the ticket, notwithstanding these terms and conditions.
Names on travel documents must match exactly those shown on passports, where applicable.
If an e-ticket has been provided by WTT, it must be taken when travelling as it may be required on demand. Customers should also have a valid form of identification during travel.
FARES AND PAYMENT
All fares quoted by WTT are subject to availability and are only available when payment has been received from the Client / Customer.
There are various ways to pay, including credit cards, bank / wire transfers and UK cheques. These and other methods are covered in the guide ‘How to Pay for Tickets and Tours’.
REFUNDS AND CHANGES TO TICKETS AND TOURS
Unless indicated otherwise in the specific terms that apply to the ticket, it is only valid for travel at the times stated on it and may not be exchanged.
If the Provider makes any change to or cancels the booking, the Provider's maximum liability may be the refund of the ticket price.
WTT is involved in the administration of refunds and changes to tickets and tours for all bookings on luxury trains, whereas the Provider handles refunds and changes to tickets and tours for all bookings on tourist trains directly with the Client / Customer.
The details concerning ticket refunds are set out in the specific terms that apply to it. If these permit a refund, WTT reserves the right to charge a processing fee of up to 20% of the cost of the ticket if WTT is involved in the administration of the refund. The Provider may charge a processing fee.
The processing fees made in respect of exchanges and cancellations, if WTT is involved in their administration, are in addition to any charges that may be made by the Provider concerned.
Refunds on partially-used tickets are not available.
All refunds will be made by any method by which WTT deems, if WTT is involved in the administration.
WTT will not be liable for any delay, poor performance or failure in performance caused by matters beyond WTT’s reasonable control.
Likewise the Provider will not be so liable.CONDITIONS OF ROVOS RAIL
When Rovos Rail (Rovos) receives a completed Reservation Form from WTT, and subject to availability, they will confirm the place(s) on the chosen tour.
Upon receipt of a 25% deposit, the reservation is confirmed with Rovos. Final payment is due no later than 8 weeks prior to departure (except for the Cairo journey when it is 12 weeks).
CANCELLATION INSURANCE IS COMPULSORY AND WILL NOT BE WAIVED
For These Tours - Cape Town, Vic Falls, Durban
Cancellations received more than 8 weeks prior to departure are subject to a cancellation fee of 5% of the per person tour price;
Cancellations received between 8 and 4 weeks prior to departure are subject to a fee of 25% of the per person tour price;
Cancellations received within the 4-week period prior to departure are subject to forfeiture of the entire tour price.
For These Tours - Golf Safari, African Collage, Namibia, Dar es Salaam
Cancellations received more than 12 weeks prior to departure are subject to a cancellation fee of 10% of the per person tour price;
Cancellations received between 12 and 8 weeks prior to departure are subject to a fee of 25% of the per person tour price;
Cancellations received between 8 and 4 weeks prior to departure are subject to a fee of 50% of the per person tour price;
Cancellations received within the 4-week period are subject to forfeiture of the entire tour price.
Cape to Cairo
All payments are non-refundable.

• 24-hour full room service and bar facilities;
• Government tax;
• Limited laundry service.

INCLUDED IN OFF-TRAIN ACCOMMODATION ON ANNUAL JOURNEYS
• Meals taken at the game reserves, hotels, clubs or resorts.
EXCLUDED FROM OFF-TRAIN ACCOMMODATION ON ANNUAL JOURNEYS
• Off-train beverages (dependent);
• Off-train laundry;
• Telephone calls;
• Memorabilia purchases.
Rovos will do its utmost to keep to the prices published. If however, increases are forced on them, they reserve the right, prior to confirmation, to amend the tour price.
SCHEDULING TIMES & ROUTES
Rovos cannot be held liable for any delays due to trains not running to schedule. Excursions cannot be guaranteed and will only be undertaken if time and circumstances permit. Departure and arrival times are approximate and cannot be guaranteed. Rovos reserve the right to alter the routing at any time between departure and arrival points.
Rovos reserves the right to amend the tour price at any time prior to written confirmation of the reservation. Rovos further reserves the right to cancel or amend any sightseeing excursions or the tour departure dates provided they can offer the passenger alternative sightseeing excursions or departure dates. Rovos is not responsible for any delay or changes in tour arrangements that may be caused by natural or other factors beyond the control of Rovos. There will be no refunds for any part of the tour that might be missed due to personal reasons.
PASSPORTS & VISAS
It is upon the client to ensure passports and visas, as may be required, are valid prior to departure.
Anti-malarial and Yellow Fever precautions may be required in the countries that are being visited and should be taken as may be prescribed.
Rovos reserves the right without notice to make use of any photography/film taken by our staff on the tour for general publicity purposes without payment or permission.
MAXIMUM TRAIN CAPACITY
Classic 1: 39 suites • Classic 2: 39 suites • Edwardian: 23 suites.
Rovos reserve the right to increase or decrease accommodation capacity as circumstances may require.
OF SPECIAL NOTE
Although certain limited insurances have been arranged, neither Rovos Rail Tours (PTY) Ltd, nor its servants, agents or employees, shall be liable for any loss or damage to passengers’ luggage or effects. Insofar as one of the tours may include a visit to a Game Reserve and whilst attacks by wild animals are extremely rare, similarly neither Rovos Rail, nor its servants, agents or employees, accept any liability whatsoever for any injury or incidents to passengers or their belongings. The passenger hereby waives any claim which he/she may have against Rovos Rail Tours (PTY) Ltd, its servants, agents, employees or subcontractors (all of the aforementioned being collectively referred to as ‘Rovos Rail’) for any injury and/or loss of any nature whatsoever (including, without limiting the generality of the a foregoing, consequential loss) arising for any reason of any nature whatever directly or indirectly out of any aspect of the tour including, without limiting the generality of the a foregoing, any form of transport used for the purpose of the tour. This waiver shall be binding on the passenger’s executors, heirs, trustees and dependants. The passenger records that all the services and facilities provided to the passenger are accepted voluntarily and with full knowledge that they may expose the passenger to injury, danger or loss. The passenger further records that any statement, representation or information given to him/her by Rovos Rail shall, unless given in writing, not prejudice this waiver in any manner whatsoever. The passenger indemnifies Rovos Rail in respect of any claim that may be made by any third party against it arising out of any claim in respect of which the passenger gives the aforementioned waiver. This agreement shall be governed solely by laws of the Republic of South Africa.
Whether the passenger returns a signed copy of these conditions or not, the conditions will be deemed to have been accepted and will be in force upon confirmation of the booking.
