GENERAL TERMS AND CONDITIONS as of 11 April 2013
When a person on behalf of a travel agency, tour operator or other travel organisation (hereinafter referred to as ‘Client’) or an individual customer ('Customer') that is registered with World Train Travel (hereinafter referred to as ‘WTT’) pays WTT a deposit or full- or part-payment for the cost of travel on a journey on a train or on a tour or for another service, operated by a train company, tour operator or service provider (hereinafter referred to as ‘Provider’), as presented by WTT, the Client / Customer enters into an agreement with the Provider for all matters relating to the journey or service connected to the booking, and full acceptance of these Terms and Conditions, and those of the Provider by the Client / Customer is assumed.
WTT is an agent; the contract is between the Client or Customer and the Provider.

RAILWAY OPERATORS’ AND OTHER CARRIERS’ CONDITIONS
The relevant conditions of carriage and byelaws of the railway operators over whose lines The Client’s customers' travels are incorporated into the contract together with those of any other carrier.
The contract also includes, where applicable, the Uniform Rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) which are applicable to the Berne Convention concerning international carriage by rail.
VARIATIONS OF THESE TERMS AND CONDITIONS
These conditions are subject to variation at any time.
Any variation will be displayed here and you will be deemed to have accepted a variation if you have made a booking after it has been displayed.
These Conditions and any appendices shall take effect on the date displayed above until further notice, or as superseded by later versions.
The Client is hereby notified that it must ensure the Client's customers have adequate insurance cover for the travel, tour or service booked by the Client with WTT. Similarly the Customer must have adequate insurance cover for the travel, tour or service booked by the Customer with WTT. Cover must include refunds, cancellations and travel plan alterations, howsoever caused. WTT accepts such a booking on the strict understanding that this insurance cover is in place.
PASSPORTS & VISAS
The Client / Customer is responsible in ensuring passports and visas, as may be required, are valid prior to departure, and for the entire duration of the journey.
BOOKINGS AND RESERVATIONS
When a ticket, tour or other service (hereinafter referred to as ‘ticket’) is reserved, WTT sends an email confirming the booking, with a booking reference number.
A booking fee may be charged.
Examine tickets carefully upon receipt. Both the Provider and WTT accept no liability for ticket errors resulting from incorrect information provided by you.
If there is any inaccuracy, the Provider must be notified within 24 hours of receipt of your tickets.
The Provider aims to ensure that all tickets booked through WTT are issued correctly and efficiently but in the event of any error or delay occurring in connection with the booking or the issue of tickets, the maximum liability to the Client or Customer will be to refund the price of the ticket, notwithstanding these terms and conditions.
Names on travel documents must match exactly those shown on passports, where applicable.
If an e-ticket has been provided by WTT, it must be taken when travelling as it may be required on demand. Customers should also have a valid form of identification during travel.
FARES AND PAYMENT
All fares quoted by WTT are subject to availability and are only available when payment has been received from the Client / Customer.
There are various ways to pay, including credit cards, bank / wire transfers and UK cheques. These and other methods are covered in the guide ‘How to Pay for Tickets and Tours’.
REFUNDS AND CHANGES TO TICKETS AND TOURS
Unless indicated otherwise in the specific terms that apply to the ticket, it is only valid for travel at the times stated on it and may not be exchanged.
If the Provider makes any change to or cancels the booking, the Provider's maximum liability may be the refund of the ticket price.
WTT is involved in the administration of refunds and changes to tickets and tours for all bookings on luxury trains, whereas the Provider handles refunds and changes to tickets and tours for all bookings on tourist trains directly with the Client / Customer.
The details concerning ticket refunds are set out in the specific terms that apply to it. If these permit a refund, WTT reserves the right to charge a processing fee of up to 20% of the cost of the ticket if WTT is involved in the administration of the refund. The Provider may charge a processing fee.
The processing fees made in respect of exchanges and cancellations, if WTT is involved in their administration, are in addition to any charges that may be made by the Provider concerned.
Refunds on partially-used tickets are not available.
All refunds will be made by any method by which WTT deems, if WTT is involved in the administration.
WTT will not be liable for any delay, poor performance or failure in performance caused by matters beyond WTT’s reasonable control.
Likewise the Provider will not be so liable.
The itineraries may be subject to modifications for reasons outside the control of the train company (Organizer) or as a result of problems which may causes changes in the operation of the rail network on which the train runs.
In these cases, the Organizer will use such solutions as may be necessary to continue the journey, without any extra cost to passengers. If passengers continue the journey under these changed arrangements, they tacitly accept the proposed solutions.
CONDITIONS SPECIFIC TO TREN CRUCERO
Tren Crucero Tourism Product is a trademark of "FERROCARRILES DEL ECUADOR EMPRESA PÚBLICA", consisting of a passenger train travelling from Quito to Durán and vice versa on a journey of 4 days and 3 nights. This high quality product has been created to make Ecuador known in its diversity and heritage wealth; and, thus meet one of the objectives of Ferrocarriles del Ecuador EP that is to link socio-economic productive activities that exist on this route.
1. Your trip with Ferrocarriles del Ecuador Empresa Pública
When deciding to travel in the Tren Crucero Tourism Product, the passenger accepts each and every one of the conditions established by Ferrocarriles del Ecuador Empresa Pública. They start from the moment the passenger by itself or through its travel agency, makes the deposit for the reservation and Ferrocarriles del Ecuador Empresa Pública issues the corresponding proof of payment. These conditions along with the information published in our literature or website are the compromise between the parties.
When you or your travel agent makes a reservation and it is accepted by Ferrocarriles del Ecuador Empresa Pública, the passenger or travel agent, must deposit 40% of the value for each ticket booked. Ferrocarriles del Ecuador Empresa Pública, after checking that bank transfer will issue the receipt or proof of payment with the conditions of the reservation, the way of payment, and the remaining balance. The balance must be paid within 30 days before the trip, and as consideration, Ferrocarriles del Ecuador Empresa Pública will issue the invoice. If the reservation is done 30 days before the trip, it must be paid in full. If the balance is not paid within the agreed time, Ferrocarriles del Ecuador Empresa Pública reserves the right to cancel the reservation and to demand that all the values established in Number 4 of this instrument be paid.
Note: Resale, endorsement, or ticket transfer from one person to another is prohibited.
The value of each ticket is set the moment the reservation is done and it is not subject to chance, except where legal. Starting September, 2013, Ferrocarriles del Ecuador EP, does not assume bank transfer costs.
4. In the event passenger wants to cancel its reservation
The passenger or any member of the group may cancel its booking at any time provided that it is done in writing and informed to Ferrocarriles del Ecuador Empresa Pública, directly or through the travel agent. The passenger will receive reimbursement of the amount paid by a bank transfer (excluding administrative and/ or cancellation expenses).
Periods of notice of cancellation and fee rates.-
The fee rate due to cancellation of a reservation will be:
45 days or more, following the date of departure, at no charge
Between 30 and 44 days before the departure date, 100% deposit of the value of the booking
Between 29 and less days before the departure date, 100% of the deposit made
Modifications or cancellations of the reservations will be charged according to our terms and conditions and/or according to Ferrocarriles del Ecuador EP suppliers' rules in the event they are higher.
5.In the event passenger wants to modify its trip's date
The passenger or any other member of the group may make a change of date of travel provided that there is a written notice to Ferrocarriles del Ecuador Empresa Pública, directly or through its travel agent, maximum 15 days in advance to the departure date, if there is availability and provided that the same characteristics of the original reservation are met, that is, the same route, the same category of the trip, and the same price.
The customer assumes the surcharge of the 35% on the total value.
6. In the event that Ferrocarriles del Ecuador Empresa Pública modifies its reservation
Due to the nature of the trip, changes may occur in the itinerary, so Ferrocarriles del Ecuador Empresa Pública reserves the right to make changes at any time. If there are changes, they will be notified to passenger in advance as soon as possible. Train travel sections contained in advertising material are subject to change, all the details that appear on them are merely indicative. The dates confirmed will be the ones that are shown on the ticket. Its programs, besides the train transfer, include accommodation, excursions, bus transportation, and food; however, Ferrocarriles del Ecuador Empresa Pública, is not the owner nor does it own buses, hotels, restaurants nor any other type of tourism service due to the present nature of the business. Ferrocarriles del Ecuador Empresa Pública acts as manager. To be the case that a supplier of Ferrocarriles del Ecuador Empresa Pública cannot offer the contracted service, all the effort will be made to comply with the itinerary.
Ferrocarriles del Ecuador EP will not be responsible for acts of God or force majeure.
7. If Ferrocarriles del Ecuador Empresa Pública cancels your reservation
Ferrocarriles del Ecuador Empresa Pública reserves the right to cancel the reservation; however, in no case may cancel the reservation 30 days before the departure date, except if its due to force majeure. If Ferrocarriles del Ecuador Empresa Pública cancels the reservation, it will reimburse the customer the total amount paid.
8.Ferrocarriles del Ecuador Empresa Pública responsibility
The responsibilities of Ferrocarriles del Ecuador Empresa Pública are only:
1. If there is any liability arising from the operation of the train or on the premises of Ferrocarriles del Ecuador Empresa Pública, derived from any claim for any incident, duly verified, except those arising from acts of force majeure, Ferrocarriles del Ecuador Empresa Pública agrees to pay any emolument under Ecuadorian law to a maximum not exceeding the amount deposited to Ferrocarriles del Ecuador Empresa Pública on account of the trip.
2. Ferrocarriles del Ecuador Empresa Pública is not responsible for loss, theft, destruction or damage to personal ítems, luggage or other belongings of passengers.
3. Up to 29 days before the trip, it is the passenger's responsibility to inform Ferrocarriles del Ecuador ailments, diseases, medical and/or food the passenger suffers, or any other type of special attention to ensure greater care possible and be able, if necessary, to provide the respective first aid. It is not the responsibility of Ferrocarriles del Ecuador Empresa Pública, to supply medical assistance, medicines, or other arising for this omission.
9. Right of Admission or to continue travel:
If a passenger is intoxicated, owns any weapons or has shown any suspicious attitude involving danger; or, attacks the moral of any other person, Ferrocarriles del Ecuador Empresa Pública will prevent his/her entry or will deprive him/her of the trip without previous notice or refund.
10. Unused services
No refund will be made for non-delivery, or use of any service or excursions offered by the Tren Crucero, under any circumstances.
Ferrocarriles del Ecuador Empresa Pública has a personal accident insurance; however, is solely the responsibility of the passenger to have international coverage insurance covering: reservation cancellation fees, unexpected reduction on his/her holidays, loss or damage to luggage, claims against third parties, medical expenses, accidents, and even life insurance as well as any other type of risk.
12. Suggestions / Complaints
Ferrocarriles del Ecuador Empresa Pública, treasures customer service; in this sense, to serve and adequately track any suggestion or complaint, passenger must inform Ferrocarriles del Ecuador Empresa Pública as soon as possible in writing or by e-mail within 15 days subsequent to the incident, stating the booking reference number and relevant information.
13. Applicable law
The conditions of the Tren Crucero Tourism Product shall be construed and governed in accordance with Ecuadorian law. The passenger accepts the conditions stated, the jurisdiction and competence established by Ferrocarriles del Ecuador EP.
Ferrocarriles del Ecuador Empresa Pública is committed to operate the Tren Crucero Tourism Product with due diligence, to warn of hazards and constraints of the journey to its tourists, and to manage the tourism activities described, of a product that because of its novelty, offers its itinerary as a guide and not as a strict route to be followed.
